Is there a death tax on superannuation in Australia?

The tax depends on who receives your super.

Taxable componentTax-free componentTax dependants

Yes, for some beneficiaries. Superannuation death tax applies when the taxable component of your super is paid to someone who is not a tax dependant, such as an adult child.

Australia has no general estate duty, but tax on superannuation death benefits does a similar job for many families. A spouse or a child under 18 receives a lump sum tax free. An adult child who is financially independent pays tax on the taxable component.

That is why superannuation death tax is a planning question, not a paperwork one. Knowing how to avoid death tax on superannuation starts with two facts: who your beneficiaries are, and how much of your balance is taxable.

How much tax is paid on a super death benefit?

A non-dependant pays 17 per cent on the taxed element of the taxable component and up to 32 per cent on any untaxed element, including the Medicare levy. The tax-free component is never taxed.

0%

Tax-free component.

Mostly your after-tax (non-concessional) contributions. Paid tax free to anyone.

17%

Taxed element.

15 per cent plus the 2 per cent Medicare levy, paid by a non-dependant on most of the taxable component.

32%

Untaxed element.

30 per cent plus Medicare levy. Often arises when insurance inside super pays out on death.

15% / 30%

Paid through your estate.

The same rates apply without the Medicare levy when the benefit is paid to your estate.

Guides on how to avoid death tax australia percentage rates all start from these figures. When people ask how to avoid death tax australia percentage questions, the answer is the same: the rate is fixed, so the planning works on the size of the taxable component and on who receives it. Consider a $600,000 balance that is 90 per cent taxable, left to two adult children. Superannuation death benefit tax on the taxed element is about $91,800. That figure is illustrative only, and your own components will differ.

Who counts as a tax dependant for super?

Under tax law, a death benefits dependant is your spouse or former spouse, a child under 18, anyone financially dependent on you, or anyone in an interdependency relationship with you. Everyone else pays tax on the taxable component.

Under ATO rules, the death benefit tax on super falls on non-dependants, which is why most adult children pay it. Search for tax on super death benefits to non dependants ATO guidance and you will find the same list of dependants. A superannuation beneficiary tax bill can be avoided for an adult child only if they were financially dependent on you or lived with you in an interdependency relationship.

Super law and tax law use different tests. An adult child can receive your super under your nomination and still pay tax on it. Your binding death benefit nomination decides who gets the money. Tax law decides what they keep, and that gap is where planning how to avoid death tax on superannuation begins.

How to avoid death tax on superannuation: what are the main strategies?

The main strategies are a recontribution strategy, withdrawing super before death, paying dependants, paying through your estate, and reviewing insurance inside super. Each has rules and trade-offs, so model them before acting.

These are the levers behind how to avoid death tax on superannuation. Which ones suit you depends on your age, balance, health and family.

1

Recontribution strategy. Withdraw part of your super and contribute it back as a non-concessional contribution, turning taxable money into tax-free money.

2

Withdraw before death. Once you are 60 and retired, withdrawals are tax free to you. Money outside super passes without the super death tax.

3

Pay tax dependants where it fits. A spouse receives your super tax free and may take it as a pension.

4

Pay through your estate. A benefit paid to your estate avoids the 2 per cent Medicare levy, and a testamentary trust may help minor beneficiaries.

5

Review insurance inside super. Insurance payouts can create an untaxed element taxed at up to 32 per cent. Holding some cover outside super can avoid that.

What is a recontribution strategy and does it work?

A recontribution strategy means withdrawing super tax free after 60 and contributing it back as an after-tax contribution, so it moves from the taxable to the tax-free component. It works best when started early and repeated over several years.

From 1 July 2026, the non-concessional cap is $130,000 a year, or up to $390,000 under the bring-forward rule if your total super balance is below $1.84 million. You must be under 75, meet a condition of release to withdraw, and stay inside the caps.

Done well, a recontribution strategy is one of the most direct answers to how to avoid death tax on superannuation. Done late or above the caps, it can create excess contributions tax. A Vista adviser models it before any money moves.

What happens if my super death benefit is paid to my estate?

Tax on super death benefits paid to estate is withheld at 15 per cent on the taxed element and 30 per cent on any untaxed element, without the Medicare levy, and the rest is distributed under your will.

Death tax superannuation rules still apply through the estate, but the 2 per cent levy saving can be worthwhile on a large balance. The trade-off is that estate assets can face claims from people who feel left out, and payment can take longer.

Your executor needs the fund's payment summary to complete the estate's tax return. Planning this route with your lawyer keeps the estate and the super rules working together.

Do the rules differ in NSW, Queensland or Victoria?

No. Super death benefit tax is a federal tax, so the same rates apply in every state and territory.

Searches for how to avoid death tax on superannuation NSW and how to avoid death tax on superannuation QLD lead back to the same federal rules. Super death tax Australia-wide is set by the Income Tax Assessment Act, not by the states.

What can differ by state is estate law, such as who can claim against an estate. That matters when super is paid to your estate, so your lawyer's input is part of any plan for how to avoid death tax on superannuation.

Have the rules changed since 2024?

The death benefit tax rates have not changed, but the contribution caps that drive the strategies have.

Guides titled how to avoid death tax australia 2024 still describe the current tax rates. From 1 July 2026, the non-concessional cap rose to $130,000 and the transfer balance cap rose to $2.1 million, which changes how much can be recontributed or kept in pension phase.

Superannuation death tax Australia rules are also affected by Division 296 for balances above $3 million. If your balance is near that level, plan both together, because the answer to how to avoid death tax on superannuation changes with the size of the balance.

Is a super death benefit tax calculator enough?

A super death benefit tax calculator gives a rough figure, but it cannot plan the strategy. It needs inputs only your fund statement shows, and it cannot weigh your family's needs.

Your components.

The split between taxable and tax-free money, found on your annual statement.

Insurance inside super.

Cover that would create an untaxed element on death.

Your beneficiaries.

Who is a tax dependant now, and who will be in ten years.

Your timeline.

Age, health and when you plan to stop work, which set what is possible.

How much tax do adult children pay on inherited super?

Adult children who are not financially dependent pay 15 per cent plus the 2 per cent Medicare levy on the taxed element of the taxable component, and up to 32 per cent on any untaxed element. The tax-free component is not taxed.

How do I reduce the 15 per cent tax on super paid to my adult children?

Is superannuation tax on death charged on the whole balance?

No. Superannuation tax on death applies only to the taxable component paid to a non-dependant. The tax-free component and any amount paid to a dependant are tax free.

Does a binding nomination reduce death tax?

A nomination decides who receives your super, which decides whether tax applies. It cannot change the tax rate, but naming a dependant or your estate can change the outcome.

No. Australia has no general inheritance tax. Super death tax applies only to super paid to non-dependants. See our page on inheritance tax australia for how other inherited assets are treated.

When is the tax paid?

The fund withholds tax before paying a non-dependant. The beneficiary then includes the payment in their tax return and may receive a credit for tax already withheld.
